Promoted Gigs: Terms of Service

The following terms of service (the “Terms”) govern your access to and use of the Promoted Gigs program (“Promoted Gigs”, the “Program”, or the “Service”) by Fiverr International Ltd. and its subsidiaries Fiverr Limited. (Lemesou 11, 2112 Nicosia, Cyprus) and Fiverr Inc. (38 Greene St. NY 10013, NY), as applicable (collectively, “Fiverr” or “we”). 

Please read these Terms carefully before you start using Promoted Gigs. By using Promoted Gigs, you accept and agree to be bound and abide by the Terms, incorporated herein by reference. If you do not want to agree to these Terms, you must not access or use the Service. These Terms are supplemental to Fiverr.com’s general Terms of Service (the “Terms of Service”), which also apply to Promoted Gigs. Capitalized terms used but not defined herein shall have the respective meanings given to them in the Terms of Service.

Promoted Gigs. The Promoted Gigs Program allows qualified Sellers to promote their business by making their Gigs visible as ads in prime locations in the marketplace (the “Ads”), within certain categories. Promoted Gigs uses a first-price auction mechanism to determine the cost and placement of ads from participating Sellers. In Promoted Gigs, Sellers pay a fee only when Buyers click on the Sellers’ Ads. Promoted Gigs is available for qualified Sellers who meet various quality metrics and are not found to be in violation of the Terms of Service and/or Fiverr’s Community Standards. 

Bids. A bid is the highest amount the Seller is willing to pay for one click on their Promoted Gig’s Ad. Higher bids may increase Sellers’ chances of winning auctions; however, other metrics—such as relevancy or quality (the likelihood of views, sales, etc.)—are also taken into consideration for determining the Gig’s “Ad rank”, which ultimately determines the auction winners.

Please note that the highest bid does not necessarily win the auction. High-quality Gigs may win auctions with lower bids (while maintaining the highest Ad ranks). Under no circumstances does the Program constitute a guarantee or obligation by Fiverr to promote your Gigs. Furthermore, we cannot promise that an Ad will be clicked, nor that if the Ad is clicked, that the Promoted Gig will be purchased. Should you win an auction, the placement of your Promoted Gig, if any, will be subject to Fiverr’s sole choice and discretion. Bids are subject to minimum amounts set by Fiverr in advance.

Auction. Promoted Gigs are based on a “First-Price Auction” process, which means that while the Gig with the highest Ad rank wins, the price that the Seller will be charged for each click (Cost-Per-Click) is based on the bid for the winning Ad, and calculated automatically by Fiverr. Ads Location. Locations of Ads on the Site are based on a variety of factors, including the bid amount, the quality of the Gig, relevance, and others, and in any event, are subject, at any time, to Fiverr’s sole discretion.

Daily Limit. The daily limit is the maximum amount a Seller is willing to pay in a single day to promote their Gigs. Sellers are required to define a daily limit in order to turn on Promoted Gigs. A day, for this purpose, is defined as a calendar day in Coordinated Universal Time (UTC).

Please note that there is no guarantee that the entire daily limit will be used on any day. The daily limit may be updated by the Seller at any point, with effect no later than the next business day.

Payment Terms. Promoted Gigs' fees are charged on a monthly basis, during the first week of each calendar month, based on the clicks made in the previous month. By default, the fee is charged from the Seller's Fiverr Credits and/or Fiverr Balance (if there are not enough Fiverr Credits). However, when there are no sufficient funds in the Seller's Fiverr Balance, the remaining fee will be charged from the payment method defined by the Seller in their account, or deducted from the Seller’s future earnings if no payment method is defined.

Sellers may be charged with indirect taxes (such as Sales Tax, VAT, or GST) depending on residency, location, and any applicable law, in addition to the fee which was calculated in the auction process. Please note that the daily limit set by the Sellers does not include any and all taxes.

Disclaimer of Warranties.

THE PROMOTED GIGS PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER FIVERR NOR ANY PERSON ASSOCIATED WITH FIVERR MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. 

Limitation on Liability.

IN NO EVENT WILL FIVERR, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES OR ANY COURSES OR ITEMS OBTAINED THROUGH THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. 

We reserve the right to suspend your account should we notice any activity we determine fraudulent or inappropriate.

Users who are suspended from Fiverr due to a violation of our Terms of Service cannot access the Program.

We may make changes to these Terms from time to time. When these changes are made, we will make a new copy of the Terms available on this page.

You understand and agree that if you use the Service after the date on which the Terms have changed, we will treat your use as acceptance of the updated Terms.

We reserve the right to suspend the Program at any time without notice.
